TERMS AND CODITIONS

The following terms and conditions will apply to all bookings, regardless of how they were made (through our website, email or telephone). Please take the time to read them before making a reservation. Please pay attention to the payment and cancellation policy before booking, as well as all the terms and conditions in this document. In these terms and conditions, the following words will mean:

“Agreement” means the confirmation of the reservation together with these terms and conditions;

“Guest” means the person to be / or already accommodated;

“Host” means MM UNION SRL with the properties Elina (8 Munteniei Street) and Elina 2 (11 Munteniei Street) from Techirghiol

“Terms and Conditions” means the terms and conditions set forth in this Agreement.

By signing the accommodation form and / or the consent given online by making one / more reservations, the guest confirms that he has been informed about the policy of application of the terms and conditions.

RESERVATION PROCEDURES

Reservations must be made in advance. Accommodation rates will be based on availability from the date of offer.

Guests will receive a written confirmation of the booking once the booking has been secured (bank or holiday card pre-authorization, bank payment, cash at reception or card payment at reception) via a deposit or travel voucher (for all bookings made through a travel agent or tour operator).

PAYMENT, TAXES AND DEPOSIT

The rates offered by the Host include VAT (9%) and city tax.

The payment method depends on the choice of the type of reservation, and the respective payment terms may vary depending on the reservation.

The guest has the possibility to pay the fee for the entire stay before and / or on arrival at the Host, as well as for the other costs or requirements requested of the Host in cash or by card, or by pre-authorizing a card. If the deposit has already been paid to guarantee the reservation, the guest will pay the difference up to the total amount paid upon arrival at the Host. The current costs will be paid only in the local currency of the Host (lei/RON), in accordance with the booking process. Alternative bidding currencies are indicative only and will be based on the Host’s internal exchange rate, and are subject to bank fluctuations.

The guest has the obligation to pay in accordance with the agreed rate for accommodation and for extra services agreed according to the offer, on the first day of stay based on the presentation of the account / offer, together with proof of deposit initially offered by the guest.

In case the bank or holiday card offered by the guest for guarantee does not have enough funds to cover the reservation, then the reservation will be considered invalid and will be canceled. The same cancellation situation applies if the guest holds a card with an invalid expiration date or which expires before the day of arrival at the Host.

By making the reservation, the guest agrees to the Host to withdraw the cancellation amount from the card used for the guarantee, as mentioned above.
Reservations must be guaranteed by paying accommodation costs or travel vouchers (for bookings made by travel agencies or tour operators). Payment can be made by electronic money transfer (in the bank account mentioned on the proforma invoice) or by bank / holiday card.

If the guest does not pay or cannot present a travel voucher at the requested time, the Host can treat the reservation as if it was canceled without further notice.

CANCELLATIONS AND NON-PRESENTATIONS

Cancellations on any reservation must be made in writing.

In case the reservation is cancelled up to 14 days before check-in there is no cancellation fee and the payment will be refunded.
In case the reservation is cancelled after the free cancellation period or in case of no show/non-presentation the guest is responsible for the payment to the Host of the cancellation fee, 30% of the reservation value.

All rooms that have been confirmed as booked will be kept for the first night of the scheduled arrival date, after which time the Host may rent them without further notice, in the event that no information has been provided on late arrival.

CHANGES TO RESERVATIONS

Changes resulting from any reservations must be made in writing. No changes will be guaranteed until received in writing by the Host. The rates resulting from the changes may vary, depending on the nature of the change, as well as the availability at the time of the change brought to the reservations.

PARKING AND AREAS OUTSIDE THE HOST

The host has its own parking with a limited number of places. The host is not responsible for the theft or destruction of motor vehicles parked in private or public parking lots near it. The host suggests to the guests to be sure that the car is locked and not to leave personal belongings in the car. The host cannot be held responsible for damages done to third parties by the guest in the area of ​​private or public parking. The guest has the obligation to behave in such a way as to prevent damage to health, property, nature and the environment.

The host is not responsible for damage caused by the guest outside the premises of its properties.

CHECK IN AND CHECK OUT POLICIES

Check In: ​​from 14:00
Check Out: until 11:00

The host is entitled to accommodate a guest or receive a visitor only if they comply with these terms and conditions. Upon arrival at the Host’s reception, the guest will present a document proving the identity (identity card, passport, driver’s license) of the Host’s employee present at the reception.
The guest will complete and hand over to the receptionist the accommodation form duly completed and signed, in accordance with the laws of Romania. In case of non-completion, the reservation will be treated as “no-show”.
Requests for earlier accommodations or later cancellations may be honored only on the day of check in and check out, depending on the availability of that day and will be subject to additional fees.

The host can store for a short period the guests’ luggage, before or after the accommodation.

In case you need an accommodation earlier than the standard one of the Host, please contact us. The host recommends booking the night before accommodation for situations where you want to guarantee accommodation earlier than standard time.
Exceeding the check-out time without prior notice of reception may lead to extra charges, including but not limited to the late check-out fee or even the accommodation fee for an additional night.

CHILD ACCEPTANCE POLICY

The host can accommodate children of all ages, but only those up to 10 (ten) years old can stay for free in existing beds, those over 10 years old are charged as adults. The guests undertake to take care of the children with whom they will stay and will not leave them unattended in the room or in the public spaces of the Host.

DAMAGE, DESTRUCTION OR OWNERSHIP OF HOST PROPERTY

The guest will be directly responsible for any damage to the room or public spaces of the Host, on any furniture, electronic equipment, sanitary ware, floors, finish or any accessory by the act produced by himself, his guests, subcontractors or guests.

If these damages are observed after the guest’s departure (without the Host having notified the Host in advance), the Host reserves the right to recover the amount of damage by charging the guest’s card, provided as a guarantee.

The host reserves the right to collect the value of any object appropriated by the guest. The fee will cover all costs of replacing the missing item.

The host reserves the right to act on any guest who tries to block and damage any equipment used to detect and / or extinguish smoke or fire (detectors in rooms and public spaces, fire extinguishers and / or hydrants).

Guests who cause such damages will be charged at any cost to the Host as a result of their action, and may be directed to leave the Host.

In the event that these damages are observed after the guest’s forfeiture, the amount of money on the card provided for the guarantee will be withdrawn.

LOST / FORGOTTEN OBJECTS

If the Host’s staff finds a personal item lost or forgotten by the guest, the Host will keep that item for a maximum of 3 (three) months from the guest’s departure date, after which the Host will treat that item at its own discretion.

BEHAVIOR

The host reserves the right to judge the level of attitude, behavior and noise accepted by the guest or his guests, who must take all necessary measures to correct the actions as requested by the staff of the Host.

In the event that no amicable settlement is reached, the Host may complete a reservation and may request the immediate departure of the guest without being obliged to return the money paid for accommodation or to pay any compensation.

The host may not accommodate persons under the influence of alcohol or drugs or any narcotic and psychotropic substances. The host reserves the right to cancel the reservation immediately without making any compensation or refund to the guest or to the guest.

The host reserves the right not to accommodate guests with an aggressive, verbally or physically insulting attitude at the time of accommodation (check in), during their stay or on the day of departure (check out). The host is entitled to cancel the reservation immediately and to make the expulsion from the room and its own premises without offering any compensation, in case these rules will be violated.

NO DISCRIMINATION

It is part of the Host’s policy not to discriminate against people based on race, color, nationality, sex, marital or social status, age, ethnicity or disability, and as a responsible host, we know we have a duty to protect our guests. and their guests, as well as staff of inappropriate behavior. The guest, his guests, the guests and the subcontractors with whom he gets in touch or (who) represent them have the obligation to adhere to this policy, and the Host manager can decide whether or not the persons who have not complied with this policy can stay with the Host.

ROOM OCCUPANCY POINT

Guests who change their already confirmed reservations are asked to notify the Host prior to planned arrival, as stated in the cancellation policy below, to avoid total penalties for services already booked and confirmed.

The number of guests that will be accommodated in any room will be limited depending on the type of room, according to the reservation. Limitations have been established for the health, safety, comfort of guests, as well as for the design and operational reasons of the Host.

The guest agrees that if the number of occupants of one or more rooms is higher than the one in the confirmed reservation, the Host will not be held responsible and will not accept more people in the conditions of that reservation.

In order to prevent any misunderstandings at the accommodation (check in), please book carefully and send us the real information on the reservation, in which the accommodation data, the tariff and the number of guests will be clearly noted. We will always try to meet the changes, needs and requests of our guests, but we will not be responsible for requests that we cannot honor following a wrong booking.

If the guest cannot be accommodated due to a dispute regarding the confirmed reservation and inconsistent with the number of people arriving at the accommodation, the reservation will be treated as “no-show” and the value of the paid services will not be refunded.

PERSONS WITH DISABILITIES

The host cannot accommodate people with disabilities, due to the lack of an elevator.

PETS

With the exception of guide dogs, pets are not allowed in the Host.

SMOKER POLICY AND FIRE LIGHTED

Smoking means the use / lighting of any type of cigarette: traditional, iqos, glo, electronic cigarette, vapo, leaf cigarettes, hookah and so on.

Smoking is strictly prohibited in all rooms and in all public spaces inside, including hallways, stairs, bathrooms, and the reception area as well as the entire ground floor of the property. Smoking is allowed only outside the building, in the public area specially designed.

A special cleaning fee will be applied in case of smoking or use of any drugs or narcotic and / or psychotropic substances. If the smoking ban as well as the use of narcotic and / or psychotropic substances is violated anywhere inside, the Host will charge a cleaning fee of 200 euros to which will be added the number of nights the room could not be used due to these violations.

Ignition of any source of fire, including candles, fireworks and / or chopsticks is strictly prohibited inside and will result in penalties of 200 euros.

For non-compliance with the situations described above, the Host has the right and obligation to notify the police and to immediately cancel the accommodation without returning any value to the guest.

WARRANTY POLICY

A valid bank or holiday card that will be used as a guarantee / deposit or for pre-authorization is required at the time of booking but also at the time of accommodation.

The host accepts MasterCard, Visa and Maestro credit cards.

The reservation guarantee can also be made by paying a deposit (advance) amounting to 30% of the total value of the reservation.

The deposit is returned in full if the cancellation is made at least 14 days before accommodation.

CONTRACTUAL RESPONSE

All terms and conditions implied by legal status or common law are excluded from this document.

The host is not responsible in case of loss or damage to the personal belongings of guests or guests. The liability of the Host is limited in accordance with legal regulations, and strictly applicable to the value of this agreement.

The host is not responsible for the damage or disappearance of the personal belongings of the guests, following their interaction with other persons besides the staff of the Host or guests / visitors of the guests, during the stay.

The host recommends to the guests to make sure that, during the whole period when they are not in the room, the room door is locked, otherwise the host does not assume responsibility for the disappearance of personal items. Guests are advised to take out travel insurance to cover the costs of any events such as loss of luggage, personal belongings, or money.

The guest is directly responsible for any damage caused inside and especially the room, including finishes, furniture, decorations, sanitary ware, linen, towels and / or bathrobes, equipment and electronic systems in the room. Any damage of any kind to movable and immovable objects made intentionally or through the negligence of the guests, or their guests / visitors will be penalized accordingly, the guest paying the value of the damaged goods, repair / replacement costs and, where appropriate, indirect damages caused to the Host, if he is unable to offer the room for accommodation.

MAJOR FORCE

The host will not violate the terms and conditions of this agreement if it is unable to honor the services described above, and will have the right to cancel a reservation if it is no longer able to provide accommodation, due to one or more of the following circumstances:

1. Any part of the Host is closed due to fire, alteration, damage or redecoration at the order of a public authority for any reason other than that decided by the Host.
2. In the impossibility of supplying the Host with gas, electricity or water coming from outside the property.
3. The host may not honor a reservation, as a result of an industrial action of its own staff or of one of the suppliers.
4. Fire, explosion, strikes or spontaneous rallies, storm, storm, lightning, floods, clogged sewers, earthquakes or the consequences of any of these lead to the inability of the Host to provide services.
5. The host or any part thereof is designated for alternative use if any of the events listed above occur.

CANCELLATIONS MADE BY THE HOST

The host may cancel any reservation immediately after a guest delays payment according to the terms and conditions at the time of booking or if a guest becomes insolvent or has an administrator appointed in his business who has become insolvent or if the guest violates any of the terms and conditions. above, and will then use its reasonable efforts to provide guests with alternative facilities to another similar property or of a comparable standard, provided that such facilities are available.

GENERAL CONDITIONS AND INFORMATION

For security reasons, a video surveillance system is active outside the buildings. The use of records is made regularly by applying the law of personal data protection.

The Host’s staff is not authorized to make use of these recordings or to make them available to third parties, except for the written request received from the police, after identification.

The Host reserves the right to deduct any amount due by the guest, and the exercise of this right is without prejudice to any other rights that the Host may have under this agreement or the law.

The agreement will be interpreted in accordance with Romanian law, and the guest agrees to submit to the jurisdiction of the courts of Constanta, Romania.

No amendment to this Agreement shall be valid unless made in writing and signed by or on behalf of either Party.

Failure to present or any delay in the exercise of any right or remedy provided for in this Agreement by law to the Host does not constitute a waiver of this (or any other) right or remedy and will not prevent or restrict the continued exercise of that (or another) right or remedy.

OPINIONS, SUGGESTIONS & COMPLAINTS

We are happy to receive your information, which you agree that the Host may use for free to reproduce, disclose and / or distribute without limitation and for any purpose, including your opinions, recommendations and experiences. We assure you that we are very open and willing to resolve any complaint / suggestion regarding reservations, cancellations, refunds requested, etc. if the complaint was received within a maximum of 3 days from the occurrence of the event that gave rise to the complaint / suggestion.

If a guest has a complaint during their stay at the Host, they must notify the Host staff as soon as possible to allow the Host manager to deal with this issue during your stay.
